PHILADELPHIA –– A Pennsylvania court has denied as moot a motion for summary judgment filed by Radiator Specialty in a benzene case, in which the defendant maintained that the plaintiffs’ claims are preempted.

In a notice of trial filed on Feb. 8, the Pennsylvania Court of Common Pleas for Philadelphia County noted that trial in the pending case is scheduled for Aug. 12 and is expected to last for 10 days.

The plaintiffs argued in their complaint that decedent David Sparrow developed Acute Myeloid Leukemia as a result of alleged occupational and non-occupational exposure to benzene-containing products.
