Monsanto to Appeal Denial of JNOV Motion Following $289 Million Roundup Verdict

SAN FRANCISCO — Monsanto Co. is appealing a California judge’s denial of its motion for judgment notwithstanding the verdict in a Roundup case that ended in a $289 million verdict, according to a recent court filing.

In a Nov. 20 notice of appeal filed in the San Francisco County Superior Court, Monsanto said it will challenge the trial court’s opinion that there is “no legal basis to disturb” the jury’s finding that the plaintiff’s exposure to a glyphosate-based herbicide was a substantial factor in his illness. The 1st District California Court of Appeal will review the ruling.
