NEW ORLEANS –– A benzene plaintiff has filed a motion to remand his CMML complaint, saying that the removing defendant “invented” facts never alleged by the plaintiff in order to create Outer Continental Shelf of the United States claims.
In the Aug. 9 motion to remand filed in the U.S. District Court for the Eastern District of Louisiana, the plaintiff further argued that, even if he had incurred injuries offshore, neither he nor any other party to the case has ever pursued claims against defendants related to that work.
