Benzene Defendant Supports Motion for Summary Judgment, Attacks Plaintiffs’ Reliance on ‘Any Exposure’ Evidence

PHILADELPHIA –– A defendant named in a benzene exposure action has backed its efforts to toss the claims, saying that the plaintiffs cannot rely on “any exposure” evidence since that theory of specific causation has been rejected by the Pennsylvania Supreme Court.

In a reply brief filed June 15 in the Pennsylvania Court of Common Pleas for Philadelphia County, defendant Castle Products Inc. maintained that the plaintiffs could not prove that the plaintiff was exposed to a benzene-containing product attributable to Castle “on a regular and frequent basis.”
