Benzene Plaintiffs Oppose Exxon’s Motion for Summary Judgment, Say Evidence Satisfies ‘Frequency, Regularity, Proximity’ Standard

PHILADELPHIA –– Plaintiffs with benzene claims pending in Pennsylvania state court have opposed a motion for summary judgment filed by Exxon, maintaining that they have presented enough evidence to support the state’s frequency, regularity, and proximity standard.

In the June 22 opposition brief in the Pennsylvania Court of Common Pleas for Philadelphia County, the plaintiffs said that the decedent was “regularly and frequently exposed to Defendant’s Exxon’s Varsol fluids and mineral spirits containing benzene with which he was in proximity to on a daily or almost daily basis, and that said exposure caused him to contract MDS, which rapidly …
