DuPont, First Chemical Corp. Move for Summary Judgment, Say They Were Bulk Supplier of Chemicals

BUFFALO, N.Y. –– Defendants named in a chemical exposure lawsuit have filed a motion for summary judgment, contending that, as a bulk supplier of the chemical, they did not have a duty to warn or instruct the plaintiff on the alleged dangers.

In a Jan. 12 motion filed in the U.S. District Court for the Western District of New York, defendants E.I. du Pont de Nemours and Company and First Chemical Corp. said that they passed along warnings to the plaintiff’s employer, Goodyear Tire & Rubber Co., who was a sophisticated user of the chemical.
