Defendants Named in Chemical Exposure Suit Oppose Proposed CMO; Say Plan Would Prevent Joint Mediation with Separate Case

BUFFALO, N.Y. –– Defendants named in a chemical exposure lawsuit have opposed the plaintiffs’ proposed case management order, saying the projected dates would prevent joint mediation between the instant case and a similar case also pending in the same district.

In a Sept. 26 memorandum filed the U.S. District Court for the Western District of New York, the defendants opposed the plaintiffs’ proposed case management order, saying that the timeline proposed by the plaintiffs will not allow the defendants sufficient time to obtain the relevant medical and employment records, review them, and prepare for a deposition.
