3rd Circuit Affirms Ruling in Favor of Defendants in Radiation, Uranium Exposure Suit

PHILADELPHIA –– The 3rd Circuit U.S. Court of Appeals has affirmed a District Court ruling in favor of defendants in a radiation exposure lawsuit, finding that the plaintiffs had failed to show a genuine issue of material fact with regard to duty, breach and causation.

In the Aug. 23 opinion, the 3rd Circuit opined that the plaintiffs had failed to offer evidence that could allow a jury to find that each plaintiff was exposed to radiation from the defendant’s uranium in a quantity enough to cause their alleged injuries.
