Monsanto Drops Appeal of Order Remanding Roundup Case That Found Plaintiffs Weren’t Saying Defendant Colluded with EPA

SAN FRANCISCO –– Defendants involved in the Roundup multidistrict litigation docket have dropped an appeal of an order granting a motion to remand, according to recent court documents.

The 9th Circuit U.S. Court of Appeals granted Monsanto’s motion to voluntarily dismiss the appeal on July 20; that same day, the appellate court issue a clerk order in which it stated that a review of the record suggested that the court may lack jurisdiction over the appeal of an order remanding a removed action to state court, saying such orders are not reviewable on appeal or otherwise.
