Pa. Benzene Plaintiffs Files Second Motion to Remand, Says Jurisdiction Lacking in Light of Recent Dismissal

PHILADELPHIA –– Benzene plaintiffs whose claims were removed to federal court have moved to remand the case for a second time, saying that the presence of two defendants that were recently dismissed from the case was the sole basis for the court’s subject matter jurisdiction.

In the April 19 motion filed in the U.S. District Court for the Eastern District of Pennsylvania, the plaintiffs said that as a result of the dismissal, the court “has lost subject matter jurisdiction and the case must be remanded to the Philadelphia County Court of Common Pleas.”
