Pa. Court Rejects Defense Efforts to Transfer Benzene Action to New York

PHILADELPHIA –– A Pennsylvania has denied defense efforts to transfer a benzene action to New York, saying that the state in which the case was filed was an “appropriate and convenient forum to host this litigation.”

In the March 6 order, the U.S. District Court for the Eastern District of Pennsylvania noted that only one defendant maintains its principal place of business in New York and that the navigable waters on which the plaintiff alleges he was injured are not limited to the areas surrounding New York.
