Pa. Court Grants Motion to Exclude Testimony of Brautbar in Pesticide Exposure Suit

PITTSBURGH –– A Pennsylvania state court has excluded expert testimony proffered on behalf of plaintiffs asserting pesticide exposure claims, finding in part that “predicting risk and establishing causation do not go hand-in-hand.”
The Pennsylvania Court of Common Pleas issued its order rejecting the testimony on Oct. 16; that same day, the plaintiffs agreed to a stipulated order entering summary judgment in the defendants’ favor.
The plaintiffs plan to appeal the judgment, sources told HarrisMartin.
Plaintiff Thomas Walsh asserted the underlying claims, contending that his exposure to pesticides, fungicides, herbicides, and insecticides caused him to develop acute myelogenous leukemia. Among the …
