CINCINNATI –– E.I. duPont de Nemours and Co. has filed a motion for summary judgment in what is scheduled to be the third C-8 personal injury multidistrict litigation case to proceed to trial, saying that the plaintiff has failed to establish specific causation in the proceedings.
In a Sept. 16 motion filed in the U.S. District Court for the Southern District of Ohio, DuPont maintained that the plaintiff could not establish that his claimed exposure to drinking water containing C-8 from DuPont’s facility “was the proximate and specific cause of his testicular cancer.”
