Parties Involved in Appeal of PCBs Exposure Order Move to Abate Appeal, Cite Potential Settlement

ST. LOUIS –– Parties involved in a polychlorinated biphenyls case docketed in the 8th Circuit U.S. Court of Appeals have jointly moved the court to abate the appeal, citing a pending agreement to settle the underlying claims.

In the Sept. 9 motion, the parties told the 8th Circuit that the settlement will take some time to implement and asked the court to abate the appeal for six months.

The parties also noted that similar settlement agreements had been reached in a number of other PCBs exposure suits, including Kelly (No. 16-3247), Olson (E.D. Mo., No. 16-00512) and Burford (E.D. Mo., …
