5th Circuit Hears Arguments Relating to Dismissal of Benzene Case in September

NEW ORLEANS –– The 5th Circuit U.S. Court of Appeals heard arguments in a benzene-related appeal on Sept. 26, according to the court’s online docket.
The Sept. 26 docket entry noted that Judges E. Grady Jolly, Catharina Haynes and James E. Graves Jr. presided over the hearing, which addressed whether a benzene plaintiff presented valid general causation testimony.
The underlying dispute involves a February order issued by the District Court, in which the court found that the plaintiff –– who alleged that benzene exposure caused her to deliver a stillborn child –– had failed to present valid general causation …
