C-8 Personal Injury MDL Court Rejects DuPont’s Challenges to Scheduling of Upcoming Trials

CINCINNATI –– The federal court overseeing the national coordinated docket for claims relating to C-8 exposure has rejected DuPont’s objections to the scheduling of plaintiffs for November 2016 and January 2017 trials, saying that the trial dates do not violate the defendant’s due process rights.
In the Aug. 30 Case Management Order, the U.S. District Court for the Southern District of Ohio said that assigning the two cases trial dates was not –– as DuPont had suggested –– a punishment for the defendant’s failure to globally settle the thousands of pending claims.
