Benzene Plaintiffs Indicate Notice to Appeal Decision Throwing out $1.76 Million Punitive Damage Award

ST. LOUIS –– An appeal filed by both the plaintiffs and defendants in a benzene case that ended in a $3.52 million verdict has been docketed with the 8th Circuit U.S. Court of Appeals, according to the court’s online docket.
On Aug. 19, the appeal was docketed with the 8th Circuit; the appellate court issued the briefing schedule the same day.
In a notice of cross-appeal filed in the Southern District of Iowa on Aug. 24, the plaintiffs indicated their intent to contest the federal court’s decision to throw out the jury’s $1.76 million punitive damage verdict.
