C-8 Plaintiff Backs MDL Court’s Denial of Post-Trial Motions, Says Evidence Backs Claims

CINCINNATI –– Plaintiffs who were awarded $1.6 million at the conclusion of the first bellwether C-8 water contamination personal injury trial have backed the MDL Court’s decision to reject post-trial motions filed by DuPont, maintaining that the defendant’s appeal ignored the class action context in which the underlying case arose.
In their merit brief filed July 28 in the 6th Circuit U.S. Court of Appeals, the plaintiffs maintained that the defendant had distorted the record and failed “to address how its own flawed litigation strategy resulted in the trial rulings that it now complaints were in error.”
