SMITHLAND, Ky. -- A Kentucky federal court has outlined briefing deadlines in a myelodysplasia benzene case that was recently amended to include a cause of action for wrongful death. Fryer v. Apex Oil Co., No. 06-CI-00170 (Ky. Cir. Ct., Livingston Cty.).
In an amended case management order filed July 19 in the Kentucky Circuit Court for Livingston County, the court also ordered the parties to complete discovery by Sept. 15.
The order also set an Oct. 15 deadline for summary judgment motions and a Feb. 4, 2011, deadline for expert witness designations.
