5th Circuit to Hear Arguments Relating to Dismissal of Benzene Case in September

NEW ORLEANS –– The 5th Circuit U.S. Court of Appeals has tentatively scheduled a benzene-related appeal for the week of September 26, according to a notice issued recently by the court.

The notice setting the case for oral argument was issued on July 18 by the appellate court.

The dispute involves a February order issued by the District Court, in which the court found that the plaintiff –– who alleged that benzene exposure caused her to deliver a stillborn child –– had failed to present valid general causation testimony and, therefore, would be unable to present specific causation testimony.
