5th Circuit Hears Arguments in Dispute Over Whether Benzene Causation Evidence Can Be Used to Support Gasoline Case

NEW ORLEANS –– The 5th Circuit U.S. Court of Appeals recently heard oral arguments in the appeal of an order dismissing a benzene lawsuit on the ground that the plaintiff had not supported her gasoline exposure case with admissible evidence, according to the court’s online docket.

In an April 25 docket entry, the 5th Circuit noted that Judges Leslie H. Southwick, Gregg J. Costa and Halil Suleyman Ozerden heard the oral arguments.

The plaintiffs asserted the claims on behalf of Bernard E. Burst Jr., whose work at a number of gas stations allegedly exposed him to benzene-containing gasoline. As …
