Calif. Court Remands Roundup Exposure Suit, Says In-State Defendants Not Fraudulently Joined

SAN FRANCISCO –– A California federal court has remanded a complaint asserting claims against Monsanto Co. for injuries allegedly incurred after using the defendant’s Roundup herbicide, concluding that the defendant had failed to establish that the plaintiff had no chance of recovering against in-state defendants.
In the May 2 order, the U.S. District Court for the Northern District of California remanded the claims to the San Francisco County Superior Court.
Plaintiff DeWayne Johnson alleged in his complaint, originally filed in the Superior Court, that he developed non-Hodgkin’s lymphoma as a result of exposure to glyphosate in Roundup. Monsanto …
