JPML Designates D.C. Circuit Court to Oversee 6 Appeals of New OSHA Silica Guidelines

WASHINGTON, D.C. –– The U.S. Judicial Panel on Multidistrict Litigation has consolidated six petitions for review of a final rule issued by OSHA that aimed to improve protections for workers exposed to silica dust, saying that the U.S. Court of Appeals for the District of Columbia Circuit Court has been randomly selected to oversee the appeals.
According to the April 12 consolidation order, the JPML received notice one day prior of multiple multicircuit petitions for review of the U.S. Labor Department’s order and, as such, randomly selected a court in which to consolidate the petition for review.
