NEW ORLEANS –– The 5th Circuit U.S. Court of Appeals has issued a scheduling order in an appeal brought by a benzene plaintiff whose claims were dismissed after a Louisiana federal court held that she failed to present admissible general causation expert testimony.

According to the March 18 notice, the plaintiff must file her appellate brief by April 27. However, on April 5 the plaintiff requested an unopposed extension until May 27 to file her brief; the 5th Circuit granted the motion in part, saying that the request “lacked substantial reason,” and that the brief was now due on …
