N.Y. Court Refuses to Certify Orders in Insurance Dispute Over Coverage for Asbestos, Silica Claims

NEW YORK –– A New York court has denied efforts by The Travelers Indemnity Co. to certify as final orders stating that it owed a duty to defend against underlying asbestos and silica personal injury claims, ruling that there are still a number of issues to be resolved in the proceedings.
In the March 30 order, the U.S. District Court for the Southern District of New York did find, however, that Travelers may amend its third-party complaint against another insurance company, citing newly discovered evidence.
