CLEVELAND –– Parties in the next C-8 exposure multidistrict litigation trial have exchanged briefing on a number of motions, with the defendant contending that the plaintiff has failed to establish specific causation and the plaintiff maintaining that DuPont continues to challenge general causation in violation of a prior settlement agreement.
In a Feb. 25 case management order, the U.S. District Court for the Southern District of Ohio noted that trial in the underlying proceedings has been pushed back by one week, to May 31.
