NEW ORLEANS –– A Louisiana federal court has granted a defense motion for summary judgment in a benzene action, citing its recent order in which it determined that the plaintiffs failed to present admissible general causation expert testimony.
In the Feb. 4 order, the U.S. District Court for the Eastern District of Louisiana said that since the plaintiff –– who alleged that benzene exposure caused her to deliver a stillborn child –– had failed to present valid general causation testimony, she would not be permitted to present specific causation testimony.
