ST. LOUIS –– Plaintiffs asserting PCBs exposure claims have moved to remand their case, saying that the named defendant does not act under the direction of the U.S. Government simply by participating in a “highly regulated industry or activity.”

In a Jan. 11 motion filed with the U.S. District Court for the Eastern District of Missouri, the plaintiffs maintained that defendant Pharmacia was not a government contractor.

In their lawsuit, originally filed in the St. Louis County Circuit Court, Thomas Kelly and Michael Krzeszewski argued that the developed non-Hodgkin’s Lymphoma as a result of exposure to polychlorinated biphenyls (PCBs) that …
