Calif. Supreme Court Declines to Review Statute of Limitations Dispute in Diacetyl Exposure Suit

SACRAMENTO, Calif. –– California’s highest court has declined to weigh in on a statute of limitations dispute in a diacetyl exposure lawsuit, allowing to stand an intermediate appellate court’s finding that the plaintiff reasonably should have been aware that his lung injury was, at least in part, caused by occupational exposure more than two years before he filed his complaint.

The California Supreme Court denied the plaintiffs’ petition for review on Jan. 13, according to the court’s online docket.
