Next C-8 Exposure Plaintiff Set for Trial Moves to Exclude Expert Opinions, Says Deadline Has Passed

COLUMBUS, Ohio –– A plaintiff whose claims are slated to be the next tried in the national C-8 exposure multidistrict litigation docket has moved to exclude the use of impermissible new expert opinions, saying that they were disclosed almost one full year past evidentiary disclosure deadlines.
In a Jan. 14 motion filed with the U.S. District Court for the Southern District of Ohio, the plaintiffs said that if the court were to allow the untimely new expert opinions, the opinions should still be excluded since they fall into the same scope as previously precluded testimony from the same experts.
