Johnson & Johnson Moves for Summary Judgment, Exclusion of Plaintiff Expert Testimony in Talc Case

ST. LOUIS –– A defendant named in a talc-related ovarian cancer suit has moved for summary judgment and to exclude the testimony of a plaintiff’s expert, saying in part that the expert has never published the conclusion that talc can cause ovarian cancer.

In a Nov. 16 motion for summary judgment, Johnson & Johnson told the U.S. District Court for the Eastern District of Missouri that the claims should be dismissed for six reasons, first being that the plaintiff has not support the “scientifically complex claims causally linking talc use to ovarian cancer” with reliable expert testimony.
