Calif. Supreme Court Declines to Review Order Reversing Award of Summary Judgment in Benzene Case

SAN FRANCISCO –– The California Supreme Court has denied a petition for review filed by a benzene defendant, allowing to stand an intermediate appellate court’s decision that reversed an award of summary judgment to U.S. Steel after it found that the defendant had not presented evidence that would negate the existence of a design defect.

U.S. Steel filed a petition for review with the state high court on Oct. 13. According to the court’s online docket, however, the petition and de-publication request was denied on Dec. 9.
