Texas Appellate Court Set to Hear Oral Arguments on ‘Jurisdictional Issue of Ripeness’ in Silica Cases

HOUSTON –– A Texas appellate court has issued an order reminding parties involved in a silica-related appeal that the underlying dispute is related to the issue of ripeness and not the “many additional issues” raised in appellate briefs.
In a sua sponte order issued Nov. 5, Judge Harvey Brown of the Texas First District Court of Appeals explained that the briefs filed in the appeal have raised “many additional issues” outside of the question of the original constitutional challenge.
