U.S. Supreme Court Declines to Hear Statute of Repose Dispute in Camp Lejeune Proceedings

WASHINGTON, D.C. –– The U.S. Supreme Court has denied a petition for writ of certiorari filed by plaintiffs with claims pending in the Camp Lejeune Water Contamination Multidistrict Litigation docket, allowing an intermediate appellate court decision on a statute of repose dispute to stand.

The court denied the petition on Oct. 5. The plaintiffs had asked the Supreme Court to review an order in which the U.S. Court of Appeals for the 11th Circuit ruled that North Carolina’s statute of repose applied to the underlying claims and did not contain an exception for latent diseases.
