Arkansas Federal Court Remands Silica Exposure Action, Says Supplier Not Fraudulently Joined

PINE BLUFF, Ark. –– An Arkansas federal court has remanded a silica exposure action, finding that a supplier of silica sand was not fraudulently joined to the lawsuit.

In the Aug. 28 opinion, the U.S. District Court for the Eastern District of Arkansas wrote that while it is thin, the plaintiff has presented a colorable factual basis that he was exposed to the supplier’s sand.

Plaintiff Herman Frazier asserted the claims, contending that he developed silicosis as a result of exposure to silica during the course of his employment, during which he worked with and around sandblasting equipment.
