Benzene Appeal Involving Dismissal of Claims Docketed in 5th Circuit Court of Appeals




NEW ORLEANS –– An appeal filed by benzene plaintiffs whose claims were thrown out on causation grounds has been docketed in the U.S. Court of Appeals for the 5th Circuit, according to the court’s online docket.

The appellate court received the case on July 9; the plaintiffs had filed their notice of appeal four days earlier.

The appeal follows a June 29 order in which the Louisiana federal court concluded that the plaintiffs had not offered any admissible evidence on general causation and, as such, cannot present evidence on specific causation.
