Louisiana Court Grants Motion to Stay in Benzene Case; Plaintiffs Sought Stay in Light of Pending Burst Appeal

NEW ORLEANS –– A Louisiana federal court has issued an order granting a motion to stay a benzene matter, administratively closing the case in the wake of a pending appeal in a similar matter.

The U.S. District Court for the Eastern District of Louisiana issued its order July 22. The plaintiffs had moved to stay the proceedings the same day, citing the “pending outcome of an appeal in a substantially similar litigation.”

The plaintiffs in the underlying case specifically cited the Burst case, in which the same federal court granted motions for summary judgment after finding that the plaintiffs’ expert …
