Louisiana Court Precludes Testimony of Peter Infante; Says General Causation Opinion is Unreliable

NEW ORLEANS –– A Louisiana federal court has again thrown out the testimony of benzene plaintiff’s expert Dr. Peter Infante, finding in part that it was inadmissible because the expert failed to rely on studies that did not isolate gasoline exposure from exposure to other substances.

In its June 16 opinion, the U.S. District Court for the Eastern District of Louisiana opined that “although evaluation of the benzene literature is generally relevant to Dr. Infante’s ultimate opinion, it, alone, cannot provide a reliable basis for Dr. Infante’s opinion.”
