CF Industries Holdings Moves to Dismiss Iowa Benzene Suit, Cites Pleading Deficiencies

DAVENPORT, Iowa –– CF Industries Holdings Inc. has moved to dismiss a benzene plaintiff’s second amended complaint, saying that the lawsuit is insufficiently pled and fails to satisfy the federal pleading standard.
In the April 17 motion filed in the U.S. District Court for the Southern District of Iowa, the defendant maintained in part that design defect and failure-to-warn claims cannot be pled under strict liability laws in Iowa.
