Plaintiffs Oppose Defense Motion to Exclude Exhibits in Louisiana Benzene Suit

NEW ORLEANS –– Plaintiffs in a benzene case have opposed a motion to strike exhibits that were not mentioned at a recent Daubert admissibility hearing, saying that the exhibits referenced by the defendants were actually discussing during the hearing and mentioned in the plaintiffs’ briefing.
The plaintiffs filed the opposition brief on April 14 in the U.S. District Court for the Eastern District of Louisiana, saying that the defendants have misapplied the judge’s ruling in their assertion that any exhibits submitted en globo, but not referenced during the hearing, would not be part of the final record.
