Defendants Filed Dozens of In Limine Motions in South Carolina Benzene Case

COLUMBIA, S.C. –– A number of defendants involved in a South Carolina benzene case have filed in limine motions seeking the preclusion of evidence on a wide variety of matters, including the consumer expectation test and reference to Proposition 65 warnings.
The motions were filed over the last month in the U.S. District Court for the District of South Carolina.
The claims were brought on behalf of Philip Boykin, who worked as a motorcycle mechanic and technician for nearly 30 years. During this time, Boykin worked with petroleum-based products that contained benzene and other polycyclic aromatic hydrocarbons.
