Dow Chemical Files Third-Party Complaint, Says Benzene Plaintiff’s Employer Owes It Defense, Indemnity

The Dow Chemical Co. has filed a third-party complaint against Turner Industries Group LLC, saying the company, as a successor-in-interest to a benzene plaintiff’s employer, owes Dow Chemical defense and indemnification.
In the Dec. 2 third-party complaint filed in the U.S. District Court for the Eastern District of Louisiana, Dow Chemical said that it entered into a contract with Nichols Construction Corp., under which the construction and maintenance service company agreed to “defend and indemnify [Dow Chemical] against a range of claims and losses, including those of the types alleged by Plaintiffs in the instant matter.”
