New Complaint Filed on Behalf of Former Texas Painter

SAN ANTONIO -- A new benzene complaint was recently filed in Texas state court in which representatives of the estate of a former painter claim that a variety of chemical exposures, including benzene, caused the development of acute myelogenous leukemia. Guajardo, et al. v. Sherwin Williams Co., et al., No. 2008-CI-21369 (Texas 166th Jud. Dist. Ct., Bexar Cty.).
In the December 31 complaint filed in the Texas 166th Judicial District Court for Bexar County, the plaintiff invoke the discovery rule, saying they only learned of the nature of the decedent's illness within the last two years.
