Safety-Kleen Moves to Dismiss Benzene Case, Cites Recent Exclusion of Expert Testimony

DETROIT –– Safety-Kleen has reasserted a motion for summary judgment in a Michigan benzene case, saying that the court’s exclusion of the plaintiff’s “only” two designated experts “precludes her case in its entirety.”

In its Oct. 31 motion, filed in the U.S. District Court for the Eastern District of Michigan, Safety-Kleen Systems Inc. argued that the plaintiffs’ case lacks expert testimony required for a prima facie showing now that the court has decided to exclude certain plaintiff expert opinions on admissibility grounds.
