DALLAS — Kano Laboratories Inc. has moved for summary judgment in a Texas benzene exposure lawsuit, asserting the plaintiffs have failed to present sufficient evidence that Kano’s product contains sufficient levels of benzene to cause the alleged injuries.
In an Oct. 27 motion filed in the Dallas County District Court, Kano argues that the assumed exposure dose presented by the plaintiff’s expert is 14,000 to 18,000 times less than the minimum indicated by the occupational health literature to increase the risk of benzene-related acute myelogenous leukemia (AML).
