Louisiana Court Dismisses Recently Amended Benzene Fraud Claims with Prejudice

NEW ORLEANS –– A Louisiana federal court has dismissed fraud claims with prejudice, saying that the benzene plaintiffs had not remedied deficiencies previously addressed by the court.

In the Aug. 18 opinion, the U.S. District Court for the Eastern District of Louisiana specifically said that the fraud claims, for the most part, grouped the defendants together, a manner of pleading that is “insufficient.”

The plaintiffs filed the action on behalf of Kevin Boudreaux, who was allegedly exposed to benzene-containing products while working as an instrument technician and maintenance worker at a variety of construction sites.
