South Carolina Federal Court Allows Benzene Plaintiffs to Seek Approval of Settlement in State Court

COLUMBIA, S.C. –– A South Carolina federal court has allowed benzene plaintiffs to seek approval of a recent wrongful death settlement with Winzer Corp. in state court.

In a two-page order issued Aug. 13, the U.S. District Court for the District of South Carolina dismissed the case as pending against Winzer and giving the plaintiffs permission to seek approval of the settlement in state court.

On Aug. 7, the plaintiffs moved the court to enter a conditional order of dismissal, otherwise known in the state as a “Rubin Order.”
