Benzene Plaintiffs With Claims Pending in S.C. Federal Court Seek Approval of Settlement in State Court

COLUMBIA, S.C. –– Benzene plaintiffs in South Carolina have asked a federal court to allow them to seek approval of a recent wrongful death settlement with Winzer Corp. in state court.

In an Aug. 7 motion filed in the U.S. District Court for the District of South Carolina, the plaintiffs also asked the court to enter a conditional order of dismissal, otherwise known in the state as a “Rubin Order.”

The Rubin Order allows the plaintiffs an additional 60 days to effect a settlement.
