PHILADELPHIA –– A benzene defendant named in a Pennsylvania state court case has filed a motion for summary judgment contesting the plaintiffs’ product identification evidence based on a lack of evidence, expert or otherwise, establishing the defendant’s liability.

In the June 13 motion, Sunoco Inc. asked the Pennsylvania Court of Common Pleas for Philadelphia County to dismiss the benzene claims asserted against it, maintaining that the plaintiff had failed to establish that Sunoco’s benzene-containing solvents were incorporated into the vapors, aerosols, mists and fogs allegedly used by the plaintiff.
