Defendants in Philadelphia Benzene Action Seek to Preclude Plaintiffs’ Industrial Hygiene, Medical Causation Experts

PHILADELPHIA –– Defendants named in a Philadelphia benzene action have filed several motions to exclude the plaintiffs’ expert testimony, in one case arguing that the plaintiffs’ industrial hygiene expert did not calculate the exposure dosage correctly.
In a June 20 motion filed in the Pennsylvania Court of Common Pleas for Philadelphia County, U.S. Steel asked the court to exclude the dermal dose opinions of Stephen Petty, arguing that the expert ignored a number of factors, including that benzene evaporates over time.
The motion is one of several filed by defendants in recent weeks challenging expert testimony.
